Terms of service
Plain-language terms for using Bright Path. They sit alongside the data & privacy details.
1. Agreement
These terms govern your use of Bright Path (the "Service"). By creating an account or using the Service you agree to them. If you are using Bright Path on behalf of a school, district or agency, you confirm you are authorized to accept these terms for that organization.
2. Accounts and caseloads
You are responsible for keeping your sign-in credentials confidential and for all activity under your account. Each caseload is controlled by its owner, who decides which colleagues can view or edit the records inside it.
You must remove members who no longer need access, and you must not share a single login between multiple staff members.
3. Student data and your responsibilities
You retain ownership of the records you enter. Bright Path processes them on your behalf so you can track goals, log data, and produce reports.
You are responsible for complying with FERPA, IDEA, applicable state privacy law, and your own organization's policies. Complete your school or district's privacy, security and data-governance review before entering real student-identifying information.
Do not upload data you are not authorized to store, and do not use the Service for anything other than educational record keeping and progress monitoring.
4. Acceptable use
You agree not to reverse engineer, resell, or attempt to gain unauthorized access to the Service or to other users' data; not to upload malicious code; and not to use the Service in a way that disrupts it for others.
AI drafting features produce suggested text only. You are the author of record: review, edit and verify every AI-assisted draft before it is used in an IEP, a report, or family communication.
5. Availability and support
Bright Path is provided on an ongoing best-effort basis. We may update, change, or temporarily interrupt the Service for maintenance. We do not guarantee uninterrupted availability.
Keep your own copy of anything you rely on for compliance. Bright Path includes export tools for exactly this purpose.
6. Export, cancellation and deletion
You can export your caseload data at any time from Settings. You can delete a caseload or your entire account from Settings; deletion removes the associated students, goals, session data, services, attendance and communications and cannot be undone.
If your account is closed for any reason, export your records first.
7. Disclaimers and liability
The Service is provided "as is" without warranties of any kind. Bright Path is a record-keeping tool and does not provide legal, educational, or compliance advice, and does not certify that any document meets a legal requirement.
To the maximum extent permitted by law, Bright Path is not liable for indirect or consequential damages, or for loss of data where you have not maintained your own exports.
8. Referral program
Referral rewards are available for new customers only. A reward is earned when a person you referred creates their first Bright Path account, completes the 14-day free trial, and their first paid membership payment is successfully collected. Free trials, unpaid accounts, seats covered by someone else's school license, and accounts that existed before the referral do not qualify.
Each earned reward is one free month, applied automatically as a 100% discount to your next billing period. Rewards have no cash value, cannot be transferred, exchanged or refunded, and can only be applied while you hold an active paid membership. One reward per referred account, with a maximum of 12 free months per 12-month period.
Self-referrals, duplicate or shared accounts, purchased traffic, spam and other misuse make a referral ineligible. If a referred membership is refunded, charged back, or canceled before the first paid period completes, the related reward may be withdrawn. We may change, pause or end the referral program at any time; rewards already applied to a billing period are honored.
9. Changes to these terms
We may update these terms as the Service evolves. Material changes will be reflected on this page with a new effective date; continued use after that date means you accept the updated terms.
10. Contact
Questions about these terms, a data processing agreement, or a district-level review can be sent through the contact address listed on the Bright Path site.
